This also includes access to any version of the FrenchifyMeNow website, as well as streaming or downloading audio/video ;
- The term « subscription » refers to your plan you purchased on our website.

2. Registration

a. Online registration

Prior to ordering services from this website, registration is required. It is crucial to maintain the security and confidentiality of your login details, including your username and password, and not disclose them to anyone else or allow anyone else to use them. By accessing this website, you agree to comply with any guidelines or regulations that we may issue regarding user conduct, which are incorporated into these Terms of Use by reference.

b. Our right to terminate your subscription

Under the following circumstances, we retain the right to terminate your registration and delete your details :

You request that we do so ;

We have reasons to believe that a third party has become aware of your registration details ;

If, in our judgment, you are engaging in activities on the website that we consider to be illegal, facilitate illegal activity, immoral, offensive, abusive, or a violation of these terms, we reserve the right to take action ;

If we determine that your use of the website, in our discretion, constitutes or could potentially constitute a violation of intellectual property rights belonging to us or any third party ;

If you upload or attempt to upload anything that we, in our discretion, consider to be a virus, Trojan horse, worm, or any other type of program that is malicious in nature ;

If you have not complied with these Terms of Use, or if we believe that you are likely to violate them in the future.

3. Your order

a. Start of the contract

Once the full payment of the Services' total price must is received, we will send an email to the address provided in your order form to confirm the acceptance of your order. This acceptance creates a legally binding agreement between us.

b. If your order can not be purchased

We will reach out to you if any information in your order is inaccurate or incomplete prior to processing it. While we strive to avoid errors, there may be instances where information or pricing on the website is not accurate. If we are unable to proceed with your order, we will notify you in writing and there will be no charge for the order.

c. Your order number

Upon accepting your order, we will assign it a unique order number and inform you of the same. It would be appreciated if you could provide us with the order number whenever you need to contact us regarding your order.

4. Your subscription

a. Free consultation subscription

The purpose of this consultation is to assess your requirements. Please note that this consultation is limited to a maximum of 15 minutes and is available for a single booking by you. It may be conducted via WhatsApp or Zoom, and we kindly request that you provide us with your relevant contact details at the time of scheduling the consultation.

b. Group classes subscription

Please be advised that upon subscription to our group classes pack, you shall be granted access to a total of thirty (30) classes, each lasting for a duration of 50 (fifty) minutes. The subscription period shall last for a maximum of six (6) months, within which you may attend the aforementioned thirty (30) classes. It is recommended that you book one (1) class per week for four (4) consecutive months in order to maintain regularity. However, you may choose to book classes at your own pace within the three-month subscription period.

Furthermore, your subscription grants you access to all necessary documents required for attendance of the classes.

Please take note that your subscription shall be automatically renewed at the expiration of the three-month period. You may choose to renew your subscription at any point before the expiration of the three-month period. In the event that you wish to cancel your subscription, kindly note that access to our services shall be available to you until the expiration of your current subscription period.

c. One-to-one classes subscription

Please be advised that upon subscription to our one-to-one classes pack, you shall be granted access to a total of eight (8) classes, each lasting for a duration of two (1) hour. The subscription period shall last for a maximum of three (3) months, within which you may attend the aforementioned eight (8) classes. It is recommended that you book one (1) class per week or two (2) for two (2) or consecutive months or one (1) month in order to maintain regularity. However, you may choose to book classes at your own pace within the three-month subscription period.

Furthermore, your subscription grants you access to all necessary documents required for attendance of the classes.

5. Your right to cancel your subscription

Please be advised that for all subscription services, your selected subscription rate shall be automatically renewed upon the conclusion of each subscription period. The cancellation of your subscription may be completed by accessing your designated account area and selecting the option to 'cancel your subscription.’

After you canceled your subscription you will still have access to our service until the end of your current subscription.

6. Our right to cancel your subscription

As pertains to downloadable products and subscription services, it is hereby agreed that FrenchifyMeNow reserves the right, at its sole discretion and with or without prior notice, to suspend or terminate your username, password, or access to the Service(s) in its entirety, should it be determined that you have acted inconsistently with the provisions outlined within these Terms of Use, or in the event of any other breach deemed to be in violation of the agreement.

7. Term, fees and payment

a. Our prices

The prices payable for our Services will be displayed on the order pages prior to you placing the order with us.

b. Payable services

In the event that you choose to avail yourself of our Services which require payment of a fee, you hereby agree to assume responsibility for remittance of all applicable charges associated with the use of said Services, including but not limited to, transaction fees, taxes, and any other supplementary charges that may apply to the purchase of permanent downloads.

Payment for such Services shall include a periodic subscription fee, charged monthly, quarterly, or annually, as the case may be, dependent on the specific Service you have elected to access.

c. Initial payment subscription

Upon registration for any of the Services, it is understood that you shall be held liable for remittance of the corresponding fees applicable to the specific Service that you have chosen to access. In the event that you provide FrenchiFyMeNow with credit card, debit card, or PayPal account details for the purpose of effecting payment of the aforementioned fees, you hereby affirm and warrant your authorization to provide such information, thereby granting Learn French with Alexa the authorization to periodically or on a one-off basis charge your credit or debit card in order to facilitate payment of the corresponding fees. This shall be carried out in accordance with the applicable fees outlined at the time of registration for the subscription service.

d. Automatic subscription Renewal

In the event that you fail to communicate your intent to discontinue the subscription, it shall be understood that the subscription shall be automatically renewed at the conclusion of each subscription period. The duration of the renewed subscription shall be identical to that of the original subscription.

At the point of renewal, the fees applicable to the Service being renewed shall be charged to your credit or debit card, or PayPal account, in accordance with the prevailing rates, provided that, if the fees have increased, a notification shall be sent to your designated email address, at least fourteen (14) days prior to the renewal date, affording you the opportunity to opt-out of the renewal process.

e. Refunds

All charges and fees made and paid prior to termination, as set forth in this agreement, including any advanced payments made for the subscription term in which the termination occurs, shall be deemed non-refundable, unless the contract has been terminated for reasons specified under clauses 4.6 (a) to (d) outlined below. In the event that the termination is due to our failure or anticipated failure to perform an obligation that falls within the aforementioned clauses, a full refund shall be issued for any products that were not provided.

Termination of the subscription shall not absolve you of any obligations to remit any charges that may have accrued up until the point of termination.

The circumstances under which you may terminate the contract and receive a full refund in a period of 30 months are as follows:

a) We have apprised you of an impending alteration to the Services or these terms, which you do not assent to;

b) We have notified you of an inaccuracy in the pricing or description of the Service you requested, and you have elected not to proceed with the transaction;

c) We have temporarily halted the provision of Services for technical reasons, or communicated our intent to do so for a duration exceeding 14 days; or

d) You have a legal entitlement to terminate the contract owing to our commission of an infraction.

f. Update to digital content

We reserve the right to update or request that you update digital content. However, the digital content must invariably correspond with the description we provided you prior to purchase.

8. Booking policy

a. What services you can book

The free consultation :

Please be advised that a complimentary consultation service, limited to one (1) session, is available for your benefit. This offer may be availed exclusively by subscribers who have duly registered on our website. The consultation service, which aims to identify your particular requirements, is conveniently accessible through direct booking on your account and is conducted by one of our expert consultants. It is imperative to note that this offer may only be redeemed once, and that the consultation session is provided free of charge.

The group classes subscription :

Kindly take note that upon payment, you are entitled to reserve eight (8) sessions through our calendar system. These sessions may be reserved in one go or on a weekly basis, subject to availability. It is crucial to be aware that each session is restricted to a maximum of ten (10) participants. Therefore, if the session reaches full capacity, booking for that particular session will no longer be possible. However, alternative session times are provided on our calendar that can be booked instead. In the event that you encounter difficulty in securing a session within the next three (3) weeks following your payment, kindly contact us at frenchifymenow@gmal.com and we will endeavor to provide a solution. Please note that each session has a duration of two (2) hours and that you have 3(three) months to fulfilled your 8 classes.

The one-to-one subscription :

Kindly take note that upon payment, you are entitled to reserve eight (8) sessions through our calendar system. These sessions may be reserved in one go or on a weekly basis, subject to availability. Different session times are provided on our calendar that can be booked. In the event that you encounter difficulty in securing a session within the next three (3) weeks following your payment, kindly contact us at frenchifymenow@gmal.com and we will endeavor to provide a solution. Please note that each session has a duration of one (1) hour and that you have 3(three) months to fulfilled your 8 classes.

c. When you can book

You are entitled to exercise your discretion in scheduling sessions within the confines of your 3 (three) months plan period. Upon the conclusion of your subscription plan, you shall be precluded from making any further reservations. Any classes that remain unbooked beyond the fulfillment of your 3 (three) months plan period shall be deemed forfeited.

d. Modify / cancel your booking

It is within your rights to make adjustments or cancel your booking provided that such changes are made no later than 48 hours prior to the scheduled commencement of the class. Any failure to comply with this requirement will result in the deduction of the class from your 8 (eight) sessions pack.

9. Events beyond our control

FrenchifyMeNow shall endeavor to ensure the continuous operation of your account and the Service(s). Nevertheless, occasional technical difficulties or maintenance may cause temporary disruptions. We shall make reasonable efforts to apprise you of any anticipated downtime expected to surpass one hour, providing no less than twenty-four (24) hours' advance notice.

FrenchifyMeNow retains the right, at its sole discretion and without prejudice, to alter or terminate, temporarily or permanently, any functions and attributes of the Website and Service(s), with or without advance notice. Furthermore, Learn French With Alexa retains the right to modify or withdraw the audio and video materials, as well as any other downloadable content, featured in any category, at any given time.

FrenchifyMeNow shall assume no liability for any direct or indirect consequences resulting from any modification, malfunction, suspension, discontinuance, or interruption of the Service(s).

Should the Services remain suspended for a period exceeding 14 days within a calendar month, we shall adjust the price accordingly to exempt you from payment during the period of suspension. In the event of an anticipated or actual suspension of more than 14 days, you may elect to terminate the contract for the affected Service(s), and any prepaid sums for the relevant period shall be promptly refunded.

10. Severance

If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

11. Dispute resolution

The Parties will use their best efforts to negotiate in good faith and settle any dispute that may arise out of or relate to this Terms & Conditions or any breach of it.
